PRODUCT LIABILITY

People purchase products expecting them to be free from defects and be fit for their purpose. 

Occasionally however, products are or can become defective and can cause injury, loss and damage. 


Australian Consumer Laws provide protections to consumers and dictate that products must be fit for their purpose and must be of merchantable quality. 


If you have used a product in line with its intended us and in accordance with the product directions, and have now suffered injury, loss and damage, you may be entitled to valuable compensation. 


It is important that you keep the defective product in its present state without alteration so that it can be examined for defects to support your claim. In some cases, the manufacturer will request that you return the defective product for their examination. In those circumstances, you should keep various photographs of the defective product to support your claims that the product was defective. 


You may be entitled to compensation under the following heads of damages: 


  1. Pain and suffering, calculated based on the severity of your injuries relative to the Most Extreme Case.
  2. Past and future medical expenses, including physiotherapy, medications, GP and specialist consults.
  3. Past and future wage loss, plus superannuation.
  4. The value of any care that you are provided or will require in the future, including the cost of commercially provided domestic assistance and cleaning services.
